| 05/08/2012 | DOCKET TEXT ORDER (no separate order issued:) Granted TENTATIVE RULING ON REQUEST FOR RELIEF FROM STAY. GRANT. Prior to confirmation, East West Bank had recorded a Notice of Default. Per the Stipulation between debtor and Mr. Yee as successor, that Notice was to be rescinded, thus requiring Mr. Yee to restart any foreclosure. The Graeb declaration (Docket 205-1) does not deny the extant defaults. If there truly is a refinance in prospect, debtor has enough time before Mr. Yee could foreclose. If debtor does not refinance, Mr. Yee should not be delayed further, particularly since the parties have been operating under a stipulated resolution of their prior disputes. Mr. Graeb apparently concedes this. See declaration at 2:15-16. If counsel for debtor accepts this tentative, he should notify opposing counsel and the courtroom deputy (Ms. Lorena Parada, 415-268-2323) no later than 4:30 PM on May 9, in which case the matter will be dropped from the May 10 calendar and counsel for Mr. Yee should serve and upload an order granting the motion for the reasons stated in this tentative ruling.
