| 05/29/2026 | DOCKET TEXT ORDER (no separate order issued:) This case is scheduled to come before the court on June 11, 2026 for a hearing on a motion for relief from stay filed by Amur Equipment Finance (Dkt. 45; the "Motion"). The Court has carefully reviewed the Motion, as well as the corresponding notice of hearing (Dkt. 46; the "NOH") and certificate of service (Dkt. 49). After review, the Court finds and concludes that notice of the Motion is fatally flawed and the hearing must be vacated. First, the NOH fails to provide the language regarding virtual hearings required by the Court's Procedures for Noticing and Conducting Hearings, which can be found at https://www.canb.uscourts.gov/procedure/san-francisco/blumenstiel-montali/procedures-noticing-and-conducting-hearings. The NOH also fails to advise that Judge Blumenstiel's 1 p.m. relief from stay calendar convenes exclusively via Zoom. Moreover, the NOH states that "Opposition to the Motion, if any, shall be presented at the hearing on the Motion." B.L.R. 4001-1(f) provides that a respondent will not be required to, but may, file responsive pleadings, points and authorities, and declarations for a hearing on a motion for relief from stay. Accordingly, the Court orders as follows: (1) The NOH is hereby stricken. (2) The June 11 hearing on the Motion is hereby vacated. (3) The Court will take no action on the Motion unless and until Movant properly notices it for hearing in accordance with the Court's procedures and the local rules. (4) The Court finds and concludes that the need to properly serve and notice the Motion constitutes compelling circumstances under 11 U.S.C. § 362(e) that justify maintaining the automatic stay in effect until the Court orders otherwise.
