| 12/15/2023 | DOCKET TEXT ORDER (no separate order issued:) After further research, it appears that a subchapter V debtor may confirm a plan without acceptance by at least one impaired class as otherwise required by § 1129(a)(10). Thus, a debtor may confirm a plan non-consensually under § 1191(b) if there is at least one class of impaired claims and no class of impaired claims has voted to accept the plan. At the hearing, Debtor stated its intention to pursue non-consensual confirmation under § 1191(b), but Debtor has not provided the court with any offer of proof that all the confirmation requirements have been met. In the interest of judicial economy, instead of filing a brief on whether Debtor may confirm a plan under § 1191(b) without receiving any votes, Debtor shall file a confirmation brief as its offer of proof that all the confirmation requirements have been met, including a showing that the plan satisfies the requirements of § 1191(b) that it does not discriminate unfairly and is fair and equitable. That non-consensual confirmation may occur without any votes should be discussed in the confirmation brief. Debtor shall file a confirmation brief by January 25, 2024. Parties objecting to confirmation shall file opposition by February 1, 2024. The confirmation hearing is continued to February 8, 2024.
