11/07/2018327Minute Order. The Court DENIED confirmation of the Debtors First Amended Plan and First AmendedPlan (Revised). Right at Home, LLC, Total Healthcare Staffing, Inc., and Right Investments, LLC shall filesupplements to their pending Motions to Dismiss on or before November 16, 2018. The United States Trustee may file a Motion to Dismiss or Convert on or before November16, 2018. The Debtor and First National Bank shall file responses to the supplemental Motions toDismiss filed by Right at Home, LLC, Total Healthcare Staffing, Inc., and Right Investments,LLC and any Motion to Dismiss or Convert filed by the United States Trustee on or beforeNovember 30, 2018. The Court will hold an evidentiary hearing on all pending Motions to Dismiss or Convert andthe Responses thereto on Tuesday, February 5, 2019 at 9:30 a.m., before the HonorableElizabeth E. Brown in Courtroom F, US Bankruptcy Court, 721 19th Street, Denver, CO80202.1. Fourteen days prior to the hearing, the parties shall:a. Exchange pre-marked exhibits with one another. Plaintiff/Movant shall usenumbers. Defendant/Respondent shall use letters. For every exhibit exceeding ten(10) pages in length, the party shall sequentially number each page of that exhibit atthe bottom of the page. Do not file the exhibits with the Court, except as provided in paragraph 2(a)(i) below. b. File with the Court and serve on opposing party(parties) a List of Witnesses andExhibits, substantially in the form of L.B.R. 9070-1.1.2. Seven days prior to the hearing, the parties shall:a. If a party desires to present exhibits in an electronic form, the party shallcontact the Court via email at courtroomf@cob.uscourts.gov to inquire aboutequipment availability and training. Tabs must extend past the side of the paper so that thewitness and the Court may easily locate each exhibit. The first page of eachbinder shall include an index in the form of Attachment 1 to this Order.b. Present testimony through witnesses who are present in the courtroom.
