All parties appeared telephonically. Debtors Counsel did not appear. The Chapter 7 Trustee presented arguments in favor of granting joint administration between the four estates (Case Nos. 25-11440, 25-11441, 25-11443, 25-11444), including stating there was cross-collateralization of the bank between the estates, there are no claims by the estates against the other estates, and that the estates would be taking joint actions for sales of assets and Joint Administration would simplify papers filed with the Court. The Court will grant the Motion for Joint Administration of the estates, with 25-11440 as the lead case. The Proposed Counsel for the Chapter 7 Trustee presented arguments regarding the employment of a relative and the difference of the language within 11 U.S.C. § 327(a) and (d). Proposed Counsel also noted AVWF has experienced partners that are ideally suited and experienced in the courses of action the Chapter 7 Trustee has indicated he will take. The Chapter 7 Trustee further noted that he has hired AVWF for years prior to the employment of his daughter. The UST renewed their objection stating that the appearance of impropriety is too great, that AVWF has higher than average rates, and multiple firms can be hired if necessary. The matter stands submitted. Orders: Oral findings and conclusions made of record. The Joint Motion for Joint Administration of Cases filed by Independent Bank and Chapter 7 Trustee filed May 14, 2025 (Doc. 20) is hereby GRANTED. A separate order will follow.
