The Debtor argued in favor of the motion as the cash flow of the business is improving, and as the cash collateral budget already accounts includes $5,000/mo for professional fees. The Debtor stated that they will provide advance notice to the Bank of interim advance payments, as requested in the objection. Creditor High Plains Bank argued that the motion is premature, and that the issue is not yet ripe for discussion, at least until the retainer is exhausted.The Court will grant the Motion for interim payment procedures to the extent of the remaining retainer, and permit fee applications for professionals employed under 11 U.S.C. § 331 every 90 days pursuant to L.B.R. 2016-2. The Debtor will circulate a revised order to the bank, which includes notice for the bank, and the new 90-day window for filing fee applications. Orders: Oral findings and conclusions made of record.
