The Court held an evidentiary hearing on July 31, 2025 to address various landlord objections to disputes over the assumption and assignment of their leases. The form of order the Court entered accurately reflects the Court's resolution of the arguments advanced and evidence considered with respect to the lease at issue. The landlord's proposed form of order includes language that describes the reasons the Court gave for resolving a different dispute raised by a different landlord. The landlord now asserts that the same reasoning applies to its lease, which it alleges (in an email sent to chambers, copied to the other parties in interest) is "factually identical." Whether that assertion is true or false, it is not a matter that the Court in fact considered in rendering its decision with respect to the lease in question.
