06/24/202596Notice of Proposed Abandonment re: Accounts Receivable listed on Schedule A/B, Part 11 of the Petition (Receivables). The Debtor was an electrical contractor. The Petition listed Receivables of 90 days old or less at $7,171,651.00, of which an unknown amount were doubtful or uncollectible; Receivables more than 90 days old at $1,816,732.00 of which $1,500,000 (estimated) were doubtful or uncollectible.; and an additional category of retainage listed at $5,364,191 portions of which may be uncollectible. Based on review, certain Receivables relate to work on construction projects that the Debtor did not complete and so would likely result in setoffs; other Receivables would have to be administered as trust funds for suppliers, subcontractors or laborers, and so would not benefit creditors generally; or would be subject to subrogation claims by sureties which bonded the work. Further, as noted below, the Receivables would in the first instance be subject to prior, perfected security interests. Last, the costs of contesting claims that the funds are not owed would require expensive litigation covering more than 50 separate jobs, which would deplete the Estates other assets.
