Also, based on what was proffered in open court by counsel for debtor of Lucena, and counsel for secured creditor Condado, which the court accepts, and also after having reviewed the second joint amended plan filed on April 11, 2025 at docket number 317, the court finds that the plan meets the requirements of section 1129(b) of the Bankruptcy Code and that the same does not discriminate unfairly and is fair and equitable with respect to each class of claims in interest that is impaired and has not accepted the plan. The stipulation between Lucena and Condado gives finality to all pending matters regarding the motion for use of cash collateral and its opposition (Dkt. Nos. 7, 11, 28, 32, 34, 43, 63, 78, 83, 89, 102, 108, 111, 121, 137, 148, 161, 174, 188, 189, 205, 236, 301). The state court litigation, the appeal filed by Condado regarding their collateral and the adversary proceeding are held in abeyance. After the order confirming the plan is entered, Condado will seek dismissal with prejudice in all three legal proceedings. The debtor Lucena Dairy, Inc. will file a proposed order confirming the plan by Friday, May 23, 2025. Order due by 5/23/2025.
