| 04/28/2025 | 126 | Minutes of Proceedings: ORDER: Counsel for Bowling Center Inc. and counsel for Planet Home Lending, LLC servicer for Luna Commercial II, LLC, stated in open court that they reached an agreement as follows: By or before May 19, 2025, Bowling Center will obtain a capital contribution of $150,000.00 from Mr. CarlosMontijo as required by Signus Corporation. By said date, Bowling Center will deposit this capital contribution into a bank account and provide proof of the same to Planet Home Lending. Also, a letter of intent must be filed with the court. If Bowling Center fails to comply with any of these requirements by May 19, 2025, it consents to the dismissal of this bankruptcy case, with a one-year bar to refile, without further notice or hearing. Once the $150,000 capital contribution is deposited into the bank account, the financial consultant Mr.Carrasquillo will move forward with Signus Corporation to complete the financing to be provided by Signus Corporation to fund the plan. By or before July 28, 2025, Bowling Center must complete the financing with Signus Corporation and file an amended plan that is consensual between Bowling Center and Planet HomeLending. If Bowling Center complies with the July 28 deadline, an agreement with Planet Home Lending will also be filed with the terms of payment to Planet Home Lending's claim. If Bowling Center fails to obtain plan financing and file an amended plan that is acceptable to Planet Home Lending by July 28, 2025, itconsents to the dismissal of this bankruptcy case, with a one-year bar to refile, without further notice or hearing. By or before May 19, 2025, Bowling Center must provide to Planet Home Lending evidence of hazard insurance covering the collateral of Planet Home Lending, with an endorsement of insurance to Planet Home Lending. Also, if Bowling Center fails to provide said evidence of insurance, it consents to the dismissal of this bankruptcy case, with a one-year bar to refile, without further notice or hearing. The confirmation hearing is scheduled for August 21, 2025, at 10:00 a.m. via Microsoft Teams. All parties that wish to appear at the Microsoft Teams hearing must familiarize themselves and follow the Procedures for Remote Appearances as per Notice 22-29 In Re: Amended Procedures for Remote Appearances, found on the homepage of our Website at https://www.prb.uscourts.gov. Bowling Center must provide notice to all parties in interest of the August 21 hearing when it files the amended plan andfile within three days thereafter a certificate of service evidencing said notice with the court. The last day for filing written acceptances or rejections of the amended plan of reorganization is fixed as not later than fourteen [14] days prior to the confirmation hearing date. A written summary of ballots mustbe filed with the Bankruptcy Court and served upon the U.S. trustee seven [7] days prior to the hearing on confirmation. Any objection to confirmation of the amended plan shall be filed and served on the debtor, debtor's counsel, the Subchapter V trustee, the U.S. Trustee, the plan proponent if other than the debtor, and parties in interest, no later than fourteen [14] days prior to the confirmation hearing date.
