08/18/202515Order Denying Request to Continue. The MATTER comes before the Court on the Request to Continue the Status Conference filed on August 18, 2025the day before the scheduled hearing. The status conference was scheduled as required pursuant to 11 USC 1188. The Bankruptcy Code provides that such status conference is to be held not later than 60 days after the entry of the order for relief. The Court acknowledges that Debtor has failed to file a report by the timelines set forth in section 1188(c); however, that does not constitute sufficient cause to continue the hearing, especially given that the 60-day deadline to hold such conference is the end of August 2025. Accordingly, the request is hereby DENIED. As set forth in the prior order (ECF No. 12), the conference will be held through remote videoconference; however, the courtroom will be open to the public during the hearing and Debtors representative and its counsel are expected to appear for the status conference either in person at the Courthouse or through remote means. At that time, and after hearing the status of the case, and after Debtor providing general information (a) the reasons for the bankruptcy filing, (b) the goals that Debtor seeks to accomplish through the bankruptcy, (c) Debtors eligibility to be a debtor in Subchapter V, among other things, and after answering questions that the Court and other parties in interest may have, the Court may decide that a further status conference should be held at a later date.
AND IT IS SO ORDERED.
