For the reasons set forth on the record, Mr. Budri found to be in contempt of Court for failing to appear in person. Mr. Budri was authorized to file a sworn declaration under seal under the penalty of perjury to explain to the Court in detail what medical condition he alleges prevents him from in person or video attendance on 6/3/26, along with whatever transportation issues he alleges he has. See Dkt. No. 255. Mr. Budri was forewarned that generalized claims of unspecified medical issues and financial issues will not suffice. Mr. Budri submitted a declaration, which was thereafter sealed. That declaration contained no disclosure of any identifiable symptom or medical condition. Likewise, the declaration contained no detail on why Mr. Budri could not travel to this hearing or the prior one (where in person attendance was commanded), absent a generalized statement of financial hardship. Mr. Budri testified that his car had bad brakes (within last two weeks), but readily admitted that he uses car locally. Court found Mr. Budris testimony to lack credibility under the circumstances and that his lack of attendance after subjecting the Court and the parties to dozens upon dozens of pleadings and email correspondence to be purposeful recalcitrance. Court further found Mr. Budri in contempt for violation of Court orders. As will be more fully set forth in a written opinion, Mr. Budri has violated, inter alia, the Vexatious Litigant Order, the Reconsideration Order and numerous other court directives regarding filing pleadings and communicating with the Court.
