[214] BENCH WARRANT Issued because Merchant has repeatedly failed to appear at the 11 U.S.C. § 341 Meeting of Creditors and failed to appear for the hearing when commanded to do so by this Courts Order, the Court has determined that a Bench Warrant should be issued for the arrest of the Debtors representative, Salim Abbas Merchant, residing at 27015 Granite Path, San Antonio, TX 78258, to compel his attendance at the reset § 341 Meeting of Creditors and the hearing on the second Order to Appear and Show Cause, both of which will take place on December 6, 2023. The United States Marshals Service and its law enforcement officers are authorized to use all reasonable force necessary, including taking physical custody of Merchant and/or entering Merchants residence, to effect this Order. The federal jailer notify the Clerk of the Court immediately, during the normal operating hours of the office of the Clerk of the Court, that the above-named is in custody. It is further ORDERED that Merchant is to remain in custody until ordered released by the judge. [219] BENCH WARRANT regarding Order to Salim Abbas Merchant to Appear Show Cause as to why he failed to appear when the case was called. A representative of the United States Marshals Service appeared and testified that the Marshals attempted to secure Merchant in accordance with this Courts Bench Warrant (ECF No. 214) but were unable to do so. Because Merchant has again failed to appear at the 11 U.S.C. § 341 Meeting of Creditors and the hearings on the Order to Appear and Show Cause and the Second Order to Appear and Show Cause when commanded to do so by this Court, the Court has determined that another Bench Warrant should be issued for the arrest and incarceration, ifIT IS HEREBY ADJUDGED and DECREED that the necessary, of the Debtors representative, Salim Abbas Merchant, residing at 27015 Granite Path, San Antonio, TX 78258, to compel his attendance at the continued hearings on the Order to Appear and Show Cause and the Second Order to Appear and Show Cause, which will take place on December 11, 2023 or on an emergency basis if the Marshals are able to secure Merchant prior to that date.
