| 08/02/2022 | 1559 | Order: On June 16, 2022, Husch Blackwell filed a final application for compensation requesting $159,121.50 in fees. The United States trustee and Husch agreed to extend the deadline for the UST to object to the fee app to July 29. On July 29, the UST -- not Husch -- filed a proposed order allowing Husch's final fee application in the reduced amount of $53,040. The docket text made by counsel for the UST states that the order is agreed by the parties, and the proposed order itself states that Husch and the UST 'have conferred and stipulate that Husch's final fee application may be approved and allowed in the total reduced amount of $53,040.50, with one half of the amount allocated to GPTIF and one half of the reduced amount allocated to GPRE." There is no stipulation in the record - the only place that this information exists is in the proposed order. This course -- an adverse party filing a proposed order purporting to reduce the relief requested by his adversary without the adversary making any supportive filing -- is peculiar. While it is tempting to simply trust the word of counsel for the UST, one wonders why a law firm requesting almost $160 thousand in fees can't be bothered to file a stipulation or a partial withdrawal of its fee request, especially if it is agreeing to reduce its request for fees by over $100 thousand. Accordingly, on or before August 9, 2022, Husch Blackwell, through an authorized officer, partner or agent, must file correspondence that either expressly waives its request for compensation in excess of the amount stated in the UST's proposed order or requests a hearing on its application for compensation. The court will take no action on the UST's proposed order until Husch complies with this order. |
