The proposed order contemplates dismissal of the case together with, among other relief, payments from funds held by the Debtor to various parties, disposition of the remaining funds, and dismissal of related adversary proceedings. The Court requires a further hearing to determine whether the proposed relief constitutes a structured dismissal and, if so, whether the contemplated payments and distributions comply with the Bankruptcy Code and the rule announced in Czyzewski v. Jevic Holding Corp., 580 U.S. 451, 46466 (2017). The Court has not determined that the proposed dismissal violates Jevic but concludes that the existing record is insufficient to resolve the issue. Accordingly, it is ORDERED:1.A status conference concerning the proposed agreed order dismissing this case will be held on October 14, 2026, at 2:30 p.m., before the Honorable Peter D. Russin, United States Bankruptcy Judge, C. Clyde Atkins United States Courthouse, 301 North Miami Avenue, Courtroom 8, Miami, Florida, 33128.2.At the status conference, the parties must be prepared to address, among other matters:a. Whether the proposed order constitutes a structured dismissal;b. The nature and legal basis of each payment contemplated by the proposed order, including the proposed payment of $50,000 as deferred compensation;c. The identity of the intended recipients of the $50,000 payment and the basis for their entitlement to the payment;d. The source of the funds from which the contemplated payments will be made and any liens or other interests asserted in those funds;e. The amount, priority, and proposed treatment of all claims against the Debtor;f. Whether any contemplated payment would depart from the priority scheme established by the Bankruptcy Code;g. Whether every creditor or other party whose rights or priority would be affected has affirmatively consented to the proposed treatment;h. The effect of dismissal under 11 U.S.C. § 349, including which prior orders and transactions would remain effective following dismissal;i. Whether cause exists for dismissal under 11 U.S.C. § 1112(b) and whether dismissal, rather than conversion, is in the best interests of creditors and the estate; andj. Whether the parties instead seek an unconditional dismissal without any Court-ordered disposition of the Debtors funds.3.No later than three business days before the status conference, the Debtor shall file a proposed distribution schedule identifying: (a) all funds presently held by the Debtor; (b) each contemplated payment and its intended recipient; (c) the asserted legal basis and priority for each payment; (d) the amount expected to remain after the contemplated payments; and (e) whether each creditor or party affected by the proposed distribution has affirmatively consented.4.Counsel for the Debtor shall promptly serve this Order on all creditors and parties in interest and file a certificate of service.***Movant is directed to serve copies of this text-only order upon required parties and file a certificate of service with the court pursuant to Local Rule 9036-2.
